Employer: 216th Judicial District Attorney’s Office

Salary: $129,065.98

Location: Gillespie and Kerr Counties

The 216th District Attorney’s Office is seeking an Assistant District Attorney Prosecutor. The 216th DA’s office is located in the beautiful Texas Hill Country and is responsible for handling all aspects of felony prosecution of adults in Gillespie and Kerr Counties, with the two major cities being Kerrville and Fredericksburg.

Main Duties:

  • Assist law enforcement as needed with investigations, review search warrant and arrest warrant affidavits, and be on call when needed.
  • Review indicted felony criminal cases for appropriate disposition/plea offer.
  • Prepare felony criminal cases for trial, including interviewing witnesses and victims, reviewing evidence, visiting crime scenes, researching case law, and filing necessary pretrial motions.
  • Represent the State in pretrial matters, including hearings on motions filed by the defense or State.
  • Represent the State in plea and sentencing hearings.
  • Conduct jury and bench trials effectively, including voir dire, witness examination, offering evidence, and making persuasive arguments.
  • Handle modification, adjudication, and revocation of probation cases.
  • Manage post-conviction proceedings, including writing and preparing reply briefs on direct appeal, pursuing State’s appeals when necessary, and responding to writs of habeas corpus.
  • Safely operate motor vehicles and travel within the district as required.
  • Perform other duties as assigned by the District Attorney and First Assistant District Attorney.

Fill-in Duties as Needed (Rarely):

  • Grand Jury/Intake - Determine if evidence is sufficient for prosecution, prepare proposed indictments, present cases to a Grand Jury, and recommend bonds to the court.

Qualifications:

  • Graduation from an accredited school of law.
  • Felony or misdemeanor jury trial experience and at least two years of criminal law practice in Texas preferred.
  • Knowledge of Texas Penal Code, Texas Code of Criminal Procedure, and Texas Rules of Evidence.
  • Must be in good standing with the State Bar of Texas.
  • Ability to pass the Texas CJIS Systems Access Policy background check.
  • Self-starter with the ability to work independently and collaboratively.
  • Strong work ethic, time management, and multitasking skills.
  • Exercise sound discretion and judgment in personal and professional life.
